POLICE called by a pub landlord in Ingleton about a disturbance found a couple arguing in a car near Ribblehead, heard Skipton Magistrates Court.

They found Stuart Sutcliffe, 37, and his girlfriend in the early hours of January 1 on the B6479 at Horton-in-Ribblesdale in a parked car with the keys in the ignition, and the engine off, the court was told.

Prosecuting, Melanie Ibbotson, said Sutcliffe did not want to provide a roadside breath test, resisted all attempts and tried to break free from police. He was arrested and taken to the police station where he also failed to provide a specimen for analysis.

Ms Ibbotson said Sutcliffe was convicted for drink driving in December, 2008.

Sutcliffe, who admitted failing to provide a specimen for analysis at Harrogate Police Station and resisting a police officer in the execution of his duty, had been arguing with his girlfriend inside and outside of the pub, the court was told.

Sutcliffe had driven a short distance away from the pub after being asked to leave by the landlord, the court heard in mitigation.

The self-employed landscaper, from Church Place, Halifax, was banned from driving for three years, and fined £200 for failing to provide a specimen for analysis, and £75 for resisting a police officer. He was also ordered to pay a surcharge of £30 and costs of £85. If he completes a drink drivers rehabilitation course, his ban will be reduced by 36 weeks.
