Settle Festival organisers fight on

Settle Festival organisers are planning to appeal against a decision to refuse a three-day music and arts event in August.

Mark Dale, who is behind the idea to stage a festival on land between Rathmell and Giggleswick, told the Herald he still felt it should go ahead and was seeking legal advice.

“We have been overwhelmed by the response to the rejection of the licence, particularly from the local community. It was almost impossible to walk around Settle on Saturday without people coming up and saying how disappointed they were.”

He has the backing of Settle mayor Coun David Heather, who is supporting a fundraising campaign which Mr Dale believes will address many of Craven District Council licensing panel's concerns.

Last week, the panel voted against the application, citing a lack of clarity on the four licensing objectives: prevention of crime and disorder, prevention of public nuisance, public safety and protection of children from harm.

The panel - Couns Robert Heseltine, David Ireton and Andy Quinn - held a two-day hearing at which there were objections from concerned residents, who cited undue noise and crime and safety concerns for festival-goers and local people.

The panel judged sufficient issues and objections had been raised on all four licensing objectives to turn the application down. It felt it was not workable to address a substantial number of concerns by imposing conditions.

Bur Mr Dale still believes the festival should go ahead and says many of the panel's concerns had already been addressed.

Responding to comments in the decision notification, Mr Dale said: "We have always said that the festival plan was organic' and would be developed over time, as is common with many events of this nature.

"Between December, when the application was submitted, and the hearing in February, considerable further work had been done, specifically addressing areas where particular questions had been raised by bodies like the police, such as the site, traffic, noise and security.

"Unfortunately this extra work was not taken into account by the licensing committee as they viewed the plan as it stood when the application was made.

"We have been overwhelmed by the response to the rejection of the licence, particularly from the local community. It was almost impossible to walk around Settle on Saturday without people coming up and saying how disappointed they were."

Mr Dale has hit back at critics who claimed the organisers were only seeking to make personal profit from the event, pointing out they had publicly committed the proceeds to community projects.

They have estimated the event would generate more than £2.5 million from outside the area into the local economy and the business plan allocated £100,000 towards promoting the festival and local area on top of the £1 million event budget.

Mr Dale won a personal development bursary from Yorkshire Forward, with which he employed staff at his workplace, Malham Tarn Field Centre, to enable him to supplement his volunteer time on Settle Festival.

He said: "To enable us to progress, we need to produce professionally-written plans by specialists in such events to show precisely how we are going to address the site-specific issues of traffic management, noise and safety.

"This has always been our intention, as stated in the operating plan, but these costs were to be funded through advance ticket sales once the licence was in place.

"We are now, therefore, setting up a development fund to enable us to pay for these reports to be carried out now, to add these to the licence application/appeal.

"We are appealing for supporters to pay £100 each to become "gold sponsors". These supporters will then be entitled to two VIP tickets to Settle Festival, making them a discount on the full ticket price.

"If the appeal is unsuccessful, or doesn't go ahead, the VIP tickets will be valid for next year, or an exclusive gold sponsor event will be held locally to say thank you. Coun David Heather, mayor of Settle, has pledged to purchase gold sponsorship number one."

The tickets go on sale today (Friday).

North Yorkshire Police have also responded to the decision to refuse the licence.

Western Area Commander Chief Supt Colin Taylor told the Herald: "North Yorkshire Police have worked with Mr Dale as event organiser throughout the preparation of his application.

"Our main responsibility as a statutory authority is to ensure public safety and we sought assurance that the planning for the event complied with national codes of conduct for event safety.

"In principle, we were not against the Settle Festival, but had a responsibility to ensure that, should it go ahead, it would be run to a high standard and would be safe for those attending and for residents of local communities.

"The licensing and appeals sub-committee felt that Mr Dale's plans did not fully address the issues raised regarding event safety. We will continue to provide advice for Mr Dale should he request it in the planning of any future event."

Mr Dale said: "The festival has always been a community-focused event. It is being run by the community and will put back into the community and I and the rest of the organising team believe that an appeal will demonstrate that many of the concerns raised have been and will be addressed and met.

"We will take everything on board with future plans, which we are working hard to develop, and will continue to work with the police and other agencies to deliver a safe and enjoyable event for the people of Craven and beyond."

Perhaps the 'offended', pseudo-middle class and noise-sensitive ofcumden NIMBY's of Rathmell and surrounding areas should all arrange a weekend trip away (perhaps to 'Dancing on Ice', The West End or some other pretencious event) to co-incide with next suggested Festival date and stop spoiling the fun of the majority.

Then again, it wouldn't suprise me if the objectors get off on spoiling it. After all there's only so much Barbara Cartland to read eh?

You've moved up here and all you do is complain. You have put lots of effort and presumably money to pay the professional witness and smart arsed lawyers to put your point across to the 3 wise councillors in order to stop the event going ahead.
Bully for you.
This area is dying - you and your ilk come here and put absolutely nothing into it. Go away.

Giggleswickian - I have moved here, but not from far away. I have put no effort into, and not paid a penny towards stopping the festival. I put plenty into the area, but that is no business of yours, or anyone elses so i won't be elaborating here.

As I have said elsewhere, I could have been persuaded with the right plans and arrangements, but these failed to materialise. The only effort I have expended is in putting my views on these sites, but it's wasted effort. After this entry, that is ceasing as nothing productive is coming from it. Time to move on. You would be advised to do the same.

If the same level of time & effort went into the festival plans as has gone into pointless remarks on web sites, perhaps the bid would have succeeded.

I won't be watching for replies.

I am a member of the Settle Festival committee and did attend the hearing. The objectors that did speak at the meeting were very professional. I just think that itÂ’s a shame that we can not use their expertise to solve some of the problems that surround the festival. Yes, we might not agree on a lot of the proposals for the festival, but I just think that their input could be beneficial to all concerned.

I would not support any event that put peoples lives at risk or peoples property to be vandalised or damaged. My involvement with the festival is on the music side, having worked in clubs & discos for over 35 years, I have seen people the worse for drink & drugs, but that is a very small percentage of people. Most people just have a good time, thatÂ’s what the entertainment industry is about.

On behalf of Settle Festival, I have been providing entertainment for functions from weddings, birthday parties, charity nights & school parties. All the monies from these events have gone to support the charities of their choice. Therefore, the festival is already providing for good causes ie Yorkshire Air Ambulance, Manorlands, Cave Rescue, Airedale hospital & many more. We have covered a large area from Kendal to Keighley, the last one in fact was a 65th birthday in Cross Hills. Every venue does appreciate what we are doing, by the way that night they gave £450 to Airedale Hospital.

I also got involved with the Settle Christmas lights switch on by putting up the trees for the shops & Running the stage on the day. The town was buzzing on the day the only down side was the weather. There was a large mixed crowd all day & no disturbances drunksÂ’ or drug users I hope we can repeat that again this year.

I got involved as an off-cumden with the festival to try & give some thing for the young ones to do. The local schools do their bit providing after school activities. As we all know, all activities nowadays cost a lot of money which I donÂ’t think the council can afford. So where is the money going to come from, the lottery? I donÂ’t think so. We donÂ’t exist up north. TheyÂ’re too busy with their London Olympics. So itÂ’s up to the local community to find ways to provide for the youth of the area.

I believe Mark Dale when he says the profits from the festival would go back in to the community. If not I would think he would have to move out of the area!! (joke)
I have read the comments and its good to debate things but lets not let things get out of hand. I know people who live in the area for and against so the only way forward as I see it is to work together.

Les Beck talks a lot of sense: he has however mentioned one thing beyond all our control (even Mark Dale's!) THE WEATHER and in this aspect the site is inappropriate,darn right dangerous I would say... much of the controversy at the hearing related to flooding on the site and the Rathmell Road ... in the last 24 hours the site has been submerged in several inches of flood water, the road barely passable .. these are facts... if 20,000 people had been camping down there it would have been mayhem ... suggest Mr Dale uses his fighting fund to offer an alternative because if he doesnt this will be an issue difficult to defend... there has been enough factual evidence over the last 12 months to make any licencing authority sceptical

Listen to the PEOPLE and ignore the "Old F*rts" who supposedly represent the community we live in.

Craven District Council is shortsighted and narrow minded and cannot see a good thing when it slaps them in the face.

Fight against the injustice of this decision and to all others reading this, lobby YOUR councillors to support the festival. This is supposed to be "YOUR CRAVEN"

Does anyone have any ideas on another suitable location in the Settle Area?

Perhaps the organisers could then look into them?

I fear that I might possibly be perceived as being one of those offcunmdens who has chosen to retire to Settle with the sole aim of objecting to anything and everything that might brighten up the drab and aimless lives of the music-loving youths of Settle and elsewhere.
This is far from the truth as I do not object to the Festival per se, but I do object to the manner in which the organiser and his team have gone about promoting and funding it.
Mr Dale seems to see himself as a Champion of the People, of those otherwise down-trodden and not-listened-to by Officialdom. Armed with all the experience he claims of being involved in the Reading Festival, he also gives the impression of seeing himself in the role of an entrepreneur.

Some thirty years ago I too thought of myself as an entrepreneur, and set out to prove it by setting up in business. At that time I remortgaged half of the family home, and borrowed other money from friends and family, ensuring that I had collateral to back up the loans. Since that time I have never received a penny-piece in loan or grant-aid from any Government Quango, local or County authority.Not a penny of tax or rate-payers' money has gone into the business.

I notice that one of the first acts that Mr Dale carried out was to tap into any source of free money he could find even though he and his team have property that they could have remortgaged in order to finance their enterprise. If the Festival enjoys such certainty of financial success as Mr Dale claims, he would have surely having been backing on a runaway winner, and he would not have been at any risk of losing his investment.

There are claims that any profit from the Festival would be put to good use in the community; these are high-sounding promises. However the Festival is in the ownership of a private limited company, of which, no doubt Mr Dale and his team are directors. That being the case they could , and no doubt would, quite legitimately, be able to claim for themselves salaries, expenses, consultancy fees etc etc. Only when these have been paid out would any profit, however little, be available for the community activities.

Being now over seventy years of age I have seen far too much of my income tax and indirect taxation being spent on such nebulous ventures as the Settle Renaissance project, into which just short of half a million pounds has already been poured with little benefit to the Settle community.

Mr Dale has from the very outset sought backing
from Yorkshire Forward (a Govt quango), Craven District Council, and the Dales National Park - all of them organisations funded from income tax, VAT, Council Tax and other forms of Government-levied taxation.If any of these organisations, particulary the CDC, has funds to spare for Festivals, I think they should find other uses for it to benefit the community at large. Perhaps they could start by reducing the Council Tax for 2008-09.
I notice now that Mr Dale and his team are going to appeal against the Licensing Committee's decision and that they are putting together a fighting-fund. Predictably they do not propose to put their hands in their own pockets but have launched an appeal for 250 benefactors to each stump up £100 - making a nice tidy £25000 in total. Not a bad day's work for a quick whip-round.

Perhaps I was more than a trifle naive all those years ago when I remortgaged my house to fund my dreams, as clearly, these days, there is a much easier and less risky way to fund being an entrepreneur - just tap into the public purse and get everyone else to pay your start-up costs.

I never expected anyone else to fund my ambitions or my pleasure and I cannot understand why Mr Dale and his team should expect others to fund theirs'.

endless repetition might just make the company directors..sorry, festival organisers...realise they have the wrong site. To all those from far and wide cursing objectors and licencing committee for their lack of foresite and NIMBYism.. the reality of flooding on the site continues unabated...it is your directors you oppressed festival supporters should be lobbying, and in this context endless repetition is appropriate .. LOCATION, LOCATION, LOCATION...

Well it's Budget day and I am pleased ton hear that Mr Dale has not been able to tap up Alistair Darling for a grant to kick-start the Festival!
Seriously though, if our budding entrepreneur, Mr dale, cannot even complete the application form to the Licensing Committee correctly, it is difficult to understand what sort of confidence does that failure raise in relation to his being able to get any of the more difficult matters right.
A festival is not a bad idea at all, but why did not Mr Dale and his co-directors start more humbly. Surely a first small-scale festival to attract 2000-3000 fans, a function that the organisers had a reasonable chance of getting right, would have been a far more sensible approach In that way it would have been possible to assess the site, the approach roads , the security..and the true extent of festival-goers' interest. No..I reckon that the Dirctors got ££££ signs in their eyes and were just greedy.

If they REALLY are so Community-minded as to wish to give the profits to charity...then I advise them to register the Festival as a Charity. By that means much suspicion and mistrust about their motives will be removed.

Julius Civilus will not have missed the point that the hidden agenda was to get an open ended licence for alcohol sales etc for the whole site.Sell the licence off to a major brewery or entertainment company for £500,000 and sail off into the sunset.Community focussed and charity minded organiser,you are having a laugh!

While im in the mood maybe the festival private company could tell us how many businesses coughed up £1000 on being tapped up for money to finance the appeal seing as not enough Gold Sponsors were crushed in the rush to help overturn refusal.Who said there isnt entertainment in Settle?

Last time I visited the area was for the sad events of 2001, locals will know what I mean, I was hoping to visit for a happy event. Hope this all gets sorted out. Good Luck Settle Music festival!
