An appeal into refused plans for a wind farm near Gargrave is to be decided by either a public hearing or inquiry.

The appeal by Energiekontor UK into the refusal last year by Craven District Council for three 100- metre turbines at Brightenber Hill was originally to be decided following written representations.

But, following representations by objectors and Skipton MP Julian Smith, the appeal hearing will now be held in public.

A spokesman for the Planning Inspectorate said that the council and Energie-kontor had been contacted and a decision would be made shortly.

He confirmed that the appeal would not now be dealt with by written representations, which would have meant the public would not have been allowed to speak, and the matter would have been dealt with by an inspector considering written representations.

Planning permission for the three turbines was turned down by all but the chairman at a special meeting of the council’s planning committee held at Gargrave Village Hall in September.

It was the second application by Energiekontor which had had its first scheme for five turbines on the same site refused by the council and also refused on appeal by the Planning Inspectorate.

The wind company believed its second scheme would be acceptable after it addressed concerns by the appeal inspector over the closeness of one of the turbines to nearby Ash Tree Farm.

But councillors also refused plans for three turbines on the site on the grounds the residential amenity of those living in the farm would still be damaged by the “dominant and oppressive” turbines.
