POLICE who attended reports of a man who had fallen off his scooter on the A65 near Ingleton, discovered he was over the drink-drive limit, magistrates were told.
Piotr Pawel Fondalinski, 29, who was driving a Peugeot Elyseo 125 scooter, provided a positive roadside breath test, and was taken to the police station where he had 82 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35.
Fondalinski, a man of previous good character, admitted drink-driving on August 28, and also using a vehicle without insurance.
The court heard Fondalinski, of New Village, Ingleton, had 'foolishly' decided to have a few drinks after finishing work.
He had broken his shoulder in his fall and had needed an operation.
He was banned from driving for 22 months and fined £180, with costs of £85 and a victims surcharge of £20. There was no separate penalty for driving without insurance.
